Delhi's Factory Licensing Landscape in 2026 — What Makes It Different
Delhi is unlike any other state in factory licensing. Four factors define the 2026 landscape:
1. Restricted Industries — Conforming Area Rule
Delhi factory licenses are granted only for factories located in Conforming Industrial Areas designated by the Delhi Development Authority (DDA) and MCD. Factories operating in non-conforming (residential or commercial) areas are legally prohibited from getting a factory license — a rule that doesn't exist in Maharashtra, Gujarat, UP, or Haryana. Public utility services are exempt from this location rule.
2. Multiple Categories Prohibited
Following Supreme Court directions and DPCC master notifications, several industry categories have been prohibited or restricted in Delhi — including large-scale metal casting, tanneries, certain chemical processes, textile dyeing, and heavy engineering. These have relocated to NCR (Noida, Faridabad, Gurgaon, Manesar). If your intended manufacturing is in a prohibited category, no Delhi factory license will be issued — no matter how compelling your application.
3. Two-Portal Reality — Labour Department + MCD
Depending on your factory's location and category, you may need to file with the Delhi Labour Department (labour.delhi.gov.in via e-District Delhi portal), the MCD Factory License system (mcdonline.nic.in/ftlmcd), or both. Most factories operating in MCD-jurisdiction industrial areas require the MCD factory license in addition to the Labour Department Rule 5 licence.
4. Aggressive Enforcement Under NGT and DPCC
Delhi is one of the most-watched jurisdictions in India for industrial compliance because of NGT (National Green Tribunal) supervision and DPCC's aggressive enforcement mandate. Who Needs a Factory License in Delhi?

Delhi Labour Department
The Chief Inspector of Factories under the Delhi Labour Department is the primary licensing authority under the Factories Act 1948 and Delhi Factories Rules 1950. Responsibilities:

Municipal Corporation of Delhi (MCD)
